1. Acceptance of these Terms
These Terms & Conditions (“Terms”) govern your use of the mobile games published by Zippy Play (“we”, “us”, “our”) on Google Play and the Apple App Store (the “Games”) and the website zippy-play.com (together, the “Services”). By downloading, installing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
The Services are intended for a general audience. If you are under the age of majority in your country, you may use the Services only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf. Parents should supervise purchases made by children.
3. Licence to play
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Games on devices you own or control, for your personal, non-commercial entertainment. You may not copy, modify, distribute, sell, rent, reverse-engineer or create derivative works from the Games, except where this restriction is prohibited by law.
4. In-app purchases and virtual items
- Some Games offer optional purchases, such as removing ads, in-game currency or cosmetic items (“Virtual Items”).
- Virtual Items have no real-world monetary value, cannot be exchanged for cash, and are licensed to you, not sold.
- All purchases are processed by Google Play or Apple and are subject to their terms. Refund requests are handled by the relevant store under its refund policy, except where applicable law requires otherwise.
- Use “Restore Purchases” in the Game settings to recover non-consumable purchases on a new device.
- Virtual Items may be lost if a Game is uninstalled, and we may change or discontinue Virtual Items as part of game updates.
5. Advertising
The Games are free and are supported by advertising from third parties. Some ads are optional (“rewarded ads”) and give you an in-game bonus for watching. We are not responsible for the content of third-party ads or for products and services advertised. Your interactions with advertisers are solely between you and the advertiser.
6. Acceptable use
You agree not to:
- cheat, hack, or use bots, mods, exploits or unauthorised third-party software;
- interfere with or disrupt the Services, servers or networks;
- attempt to obtain Virtual Items or rewards through fraud or unauthorised methods;
- use the Services for any unlawful purpose or in violation of these Terms.
7. Intellectual property
The Games and the Website, including all code, graphics, characters, sounds, music, text, names and logos, are owned by or licensed to Zippy Play and are protected by copyright, trademark and other laws. Nothing in these Terms transfers any ownership rights to you.
8. Feedback and ideas
We welcome feedback and game ideas. If you send us any, you agree that we may use them freely without any obligation or compensation to you. We may already be developing similar ideas independently.
9. Third-party services
The Services may include or link to third-party services (such as ad networks, analytics tools and app stores). These are governed by their own terms and privacy policies, and we are not responsible for them.
10. Updates and availability
We may update, change, suspend or discontinue any Game or feature at any time, including to fix bugs or comply with store requirements. Some updates may be required to continue playing. We do not guarantee that the Services will always be available or error-free.
11. Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, Zippy Play will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress or Virtual Items, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater. Some jurisdictions do not allow these limitations, so they may not apply to you, and nothing in these Terms affects your statutory rights as a consumer.
13. Termination
We may suspend or end your access to the Services if you breach these Terms. You may stop using the Services at any time by uninstalling the Games. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.
14. Apple and Google
These Terms are between you and Zippy Play only, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Games or their content, maintenance, support or warranty. For Games downloaded from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the Games must also comply with the applicable store’s terms of service.
15. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continuing to use the Services after changes take effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which Zippy Play is established, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply.
